3. The essentials in brief

You can use our website without providing any personal information. We only process personal data where this is necessary to operate the website or where you provide data to us yourself, for example via a form. We do not use advertising or analytics cookies, and no tracking. This English translation is provided for information; the German version is authoritative.

4. Website hosting

This website is hosted by Webflow, Inc., 398 11th Street, Floor 2, San Francisco, CA 94103, USA. When you visit the website, Webflow processes technically necessary data such as your IP address, date and time of access, page accessed, browser type and operating system (server log files). This is necessary to deliver the website and ensure its security.

The legal basis is our legitimate interest in a secure and functional website (Art. 6(1)(f) GDPR). We have concluded a data processing agreement with Webflow in accordance with Art. 28 GDPR. As data may be transferred to the USA, the transfer is based on the EU-US Data Privacy Framework and, additionally, on the European Commission’s standard contractual clauses.

5. Our own media server

We load videos, PDF documents and some images from our own server cdn.profilingvalues.com. It is operated by ALL-INKL.COM – Neue Medien Münnich, Hauptstraße 68, 02742 Friedersdorf, in Germany. Technically necessary data such as your IP address is processed in order to deliver the files. The legal basis is Art. 6(1)(f) GDPR.

6. Cookies and local storage

We only use technically necessary storage, for example to submit a form correctly. No consent is required for this (Section 25(2) No. 2 TDDDG). We do not use advertising or analytics cookies.

7. Contact form and email

When you write to us via the contact form or by email, we process your details (name, email address, company, optionally phone number, your request) in order to answer your request. The contact form is processed via Webflow (see section 4); your message is delivered to us by email.

The legal basis is Art. 6(1)(b) GDPR if your request relates to a contract, and otherwise our legitimate interest in answering your request (Art. 6(1)(f) GDPR). We delete the data once your request has been dealt with and no statutory retention obligations apply.

8. Newsletter

For our newsletter, we process your email address and name. Registration uses a double opt-in procedure: you only receive the newsletter after clicking the link in the confirmation email. We store the time of registration and confirmation as well as your IP address in order to be able to prove your registration.

The newsletter is sent via ActiveCampaign, LLC, 1 North Dearborn Street, 5th Floor, Chicago, IL 60602, USA. The registration form is loaded from ActiveCampaign. ActiveCampaign evaluates whether a newsletter was opened and which links were clicked, so that we can improve the newsletter. We have concluded a data processing agreement with ActiveCampaign; transfers to the USA are based on the EU-US Data Privacy Framework and standard contractual clauses.

The legal basis is your consent (Art. 6(1)(a) GDPR). You can withdraw it at any time via the unsubscribe link in every newsletter or by email to datenschutz@profilingvalues.com.

9. Free self-test

If you request the free self-test, we process your first name, last name, email address, company and position. The form is loaded and processed by ActiveCampaign (see section 8). After submitting the form, you receive your access to the method directly on the website. We use your details to check whether the requirements for the free test are met, to send you your report and to invite you to a feedback session.

The legal basis is Art. 6(1)(b) GDPR (performance of the service you requested). We process the data from the method itself as described in section 11.

10. Appointment booking via Microsoft Bookings

For appointments, we link to Microsoft Bookings, a service of Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland. A connection to Microsoft is only established when you click the link. There you enter your name, email address and optionally your phone number. We have concluded a data processing agreement with Microsoft. The legal basis is Art. 6(1)(b) GDPR or our legitimate interest in simple appointment scheduling (Art. 6(1)(f) GDPR). You can also arrange appointments by email or phone.

11. The profilingvalues method

If you take part in the profilingvalues method, we usually act as a processor on behalf of the company or consultancy that invited you. The respective controller is then responsible for informing you about this processing. For the free self-test, we are the controller ourselves.

The method platform is operated by ALL-INKL.COM – Neue Medien Münnich, Hauptstraße 68, 02742 Friedersdorf, in Germany. abakus Computer GbR, Ludwig-Auer-Str. 1a, 92358 Schnufenhofen, is commissioned with hosting the raw data. The data is stored exclusively in Germany. The method does not constitute profiling or automated decision-making within the meaning of Art. 22 GDPR.

12. LinkedIn posts

Our LinkedIn posts can be displayed on the Insights page. They are loaded via the Elfsight service. The posts are only loaded once you activate them with a click. Only then is data such as your IP address transmitted to Elfsight and LinkedIn. The legal basis is the consent you give by clicking (Art. 6(1)(a) GDPR).

13. Job applications

We are not currently accepting applications. We review unsolicited documents and then delete them, at the latest after six months. The legal basis is Section 26 BDSG or Art. 6(1)(b) GDPR.

14. External links

Our website contains links to other providers, such as podcast platforms, YouTube or LinkedIn. Data is only transmitted to the respective provider once you click such a link. The respective provider is responsible for processing there.

15. Storage period

We only store personal data for as long as is necessary for the respective purpose or as required by statutory retention periods (e.g. under commercial and tax law).

16. Your rights

You have the right of access (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR), data portability (Art. 20 GDPR) and to object to processing based on legitimate interests (Art. 21 GDPR). You can withdraw any consent given at any time with effect for the future. An email to datenschutz@profilingvalues.com is sufficient.

You also have the right to lodge a complaint with a data protection supervisory authority. The authority responsible for us is the Bavarian State Office for Data Protection Supervision (Bayerisches Landesamt für Datenschutzaufsicht), Promenade 18, 91522 Ansbach, Germany.

17. Data security

This website is protected by SSL/TLS encryption. You can recognize this by the padlock symbol in your browser’s address bar.

18. Changes

We adapt this privacy policy when our website or the legal situation changes. The current version applies.
