These General Terms and Conditions apply to the booking of certification courses and the purchase of access codes for the profilingvalues method. Our offer is directed exclusively at entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB).
The contract is concluded when we confirm an order or provide the ordered service. Individual agreements take precedence over these terms.
The content and scope of our services are set out in the respective offer, course description or order. The prices agreed at the time the contract is concluded apply.
Invoices are payable within 14 days of receipt without deduction. Any agreed payment in installments follows the individually agreed payment schedule.
A binding booking of a certification course creates the obligation to pay the agreed course fee. Non-attendance alone does not cancel this obligation. Statutory rights of termination and other rights to end the contract remain unaffected.
Different arrangements regarding rebooking, substitute participants or early termination can be agreed individually.
Certification requires fulfilment of the requirements set out in the course description.
Ordered access codes are provided and activated in the customer’s back office. Invoicing follows.
The customer may use the access codes for their own purposes or for their clients and pass them on to the intended participants. The customer protects their back-office access against unauthorized use.
The training materials provided as part of the certification may be used for personal and internal training. Passing them on to third parties, publishing them or using them to run one’s own external training courses requires our consent.
The intended use of the access codes and the associated result reports for one’s own purposes and client assignments remains unaffected. No further rights to the method, the software or the training materials are transferred.
The profilingvalues method supports the assessment of abilities, potential and inclinations. It does not replace medical or psychotherapeutic diagnostics. Professional and personnel decisions remain the responsibility of the respective decision-maker.
Both parties treat confidential information from the collaboration as confidential. Personal data may only be processed and passed on within the framework of the applicable data protection regulations. Further information can be found in our privacy policy; any required separate data protection agreements remain unaffected.
We are liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health.
In cases of simple negligence, we are only liable for breach of an essential contractual obligation whose fulfilment enables the proper performance of the contract and on whose compliance the customer may regularly rely. In this case, liability is limited to the foreseeable damage typical for the contract at the time it was concluded.
Otherwise, liability for simple negligence is excluded. Mandatory statutory liability remains unaffected.
The law of the Federal Republic of Germany applies.
The place of jurisdiction for all disputes arising from the contractual relationship is the registered office of profilingvalues GmbH.
